                 AOR Received- April 2011 from new delhi with the following timelines

Confirmation of receipt of : 3 months
First review : 9 months
Interview : 43 months

The processing time just for approval in Mississauga is just ridiculous for parental sponsorships. CIC favours illiterate and fake refugees compared to working class parents of immigrants, unfortunately

yes, waiting game has started...but i am wondering that lot of people mentioned not getting any AOR till 3 or 5 months passed. In your case, they provided after one month. i am happy that may be they will process it soon.

I have noticed that peoples are not sending all the documents that will delayed their case usually they generate file# within 2 months. anyway I am hoping for the best for all of us.

Hi I sent in all the documents when i sent the sponsorship like my birth certificate and stuff...but they asked for it again..i thought they didnt need to send it..

it depends on the immigration officer or the person who look after the files may be he had a fight with his wife & he decided not to approve a single file today. lol

aad809: From your timeline it looks like, even after the documents are sent from CIC Mississauga to CHC Delhi, it will take around 4 years for completion. Is it correct? CIC website shows the  current processing time for New Delhi  as 30 months.

41 months to get approval from CHC-M & hoping to get finalize the immigration from CHC-ND within 30 months.

i think so too....if it is a routine case it gets done faster...i mean depending on the complexity of the whole file. I spoke to someone and they had their case completed in less than 1 year from new delhi. Because, their parents visited canada for few months and go back. only one dependent child..so hopefully ours will be done soon....

I am new to the forum and need some help.
 
Question: In 2007,I applied at CIC-Missisuasaga for sponsoring my Parents for PR. This application hasn't open yet and current processing time is 43 or more months.I have extending their TRV Visa.Can I apply on Humanitarian grounds for my parents as they are already here in canada with their pending case of sponsorship at CIC-Missuasaga.Also do we have to withdraw parent's sponsorship case first from CIC-Missisuasaga and then filed their Humanitarian Grounds case here in Canda,I need help.

I also have some confusion on IMM 1344A : APPLICATION TO SPONSOR AND UNDERTAKING Section C Question 5 on Page 3
"Have you submitted a previous sponsorship application in respect of which a final decision has not been made for any of the persons named in this section?"
select Yes or No.
As I already signed APPLICATION TO SPONSOR AND UNDERTAKING form for my parents sponsorship in 2007 and now it is the same 1344A form which I have to sign as a sponsor to filed their case on Humanitarian grounds,so here I want to know can I consider both (1344A) undertaking forms are seprate in both cases.(Parent sponsorship/Humanitarian Grounds)

unfortunately the reason u provide for Humanitarian grounds is not sufficient for CHC, whereas these application even take more time the only benefit is they can live with you but without health coverage unless u take private coverage. CHC is doing sep 2007 I think ur going to receive approval shortly the best bet would be to get an multiple visa make sure their passport has sufficient validity & CHC delhi can issue an multiple visa for 5yrs. If you still want to apply on humanitarian grounds please consult any professional.

Congrats on your father getting 5 year multiple entry visa Smile

I am Permanent Resident in Canada and live in Toronto. I would be grateful if you can advice on how you managed to get that for your parents. I want to apply for the same 5 year visit visa to Canada for my mom and dad who are in India/Oman. The application form only has a tick box for single entry or multiple entry, but it does not specify how many years multiple entry.

Plus can you advice how many weeks it took for your to get the visit visa for your father and from which visa office did you apply?

thanks nina, this would be dad's 3 visit to canada since 2008 & he lives here over 2 yrs since then
you need to select multiple entry in the app form but its totally up to the visa officers, all u need to do is to make sure their passport validity is more than 5 yrs & I am sure they will issue 5 yrs multiple visa. coz 2nd time when we applied for visa there was only 14 months left on his passport & visa officer issued 13 months multiple visa. you just cant specify # of yrs.

Hello All,
 
I am new to this forum and am getting frustrated and disappointed in the whole immigration process.
 
I, myself, am a canadian citizen and my wife is a PR.  We had applied for my father-in-law back in dec 2006.
 
CIC Mississauga received the application Jan 2007 and processed it.  Decision was made from CIC- M back in Sept 2009. The file is is now with CHC New delhi as of Sept 2009 but no contact has been made from CHC new Delhi and we applied through WWICS (as recommended by family).  It is still showing in process.
 
My question is that on CHC's website it shows 30 months but is that the total time or up to that time and can be processed earlier?
 
 
Why the delay from CHC New Delhi?

We applied to CPC-M in 05/2009.
Today received a letter returning original documents back (such as T4, signed sponsorship agreement). They said they kept copies.

Has anyone else received original documents back from CPC-M even though it is still years away from a decision?
I'm just puzzled by them "returning original documents" at this time even though they are not processing file anyway, they are so far behind.

Because the instructions state send copies. You keep the original 1344.

hi.. plz reply if someone can help me out.
 this thursday we get a letter from ND CHC requesting refilled submission of immi. froms, my education update, my original educational degrees, dmcs, new pccs with medical request and passport submission. also asked to pay landing fee by sponsor... will they issua visa soon?

my time line:

application at CPC-Miss           : may 2007
sponsorship approved            : april 2010
application submit at ND CHC and started processing : may 2010
CHC requested after 1year, may 2011:    updates, medicals and original passports

as far as I know they can ask any information any time but immigration forms again is totally weird, dont understand that. anyway you have to submit whatever being asked.

I am confused as they sends medical papers & ask for passport & landing fees coz u need to bring ur original passport while going for medical.

They have just started processing your application. I think they are processing application received up to April 2009 in CHC New Delhi.
Hope this will help you.

PS- Delhi is taking forever for processing parent application. No one knows what will happen to parent sponsorship in future. Let's hope for the best.

Is ND CHC requested extra docs like re-filled application forms, Pccs, landing fee, snaps. recently this type to docs request adopted by cic so nothing can predicted may b they send visa soon or may take some time but they have an obligation to send something in a 1year from medical bcoz the medical should b valid when a person land in canada. just keep hand-crossed nd hope for good.

CIC started an online consultation that aims to seek our feedback on Canada’s immigration program. They are asking for our input on:

a) the right level of immigration to Canada (how many?), and;
b) the right mix between the three immigrant classes to Canada (economic, family and protected persons).


Should immigration levels be higher? Which of these areas should be a priority? If CIC should raise levels in one of these areas, where should Canada take less?

A report on the consultations, including a summary of this online consultation questionnaire, will be available on the CIC website in fall 2011 or winter 2012.

This is an opportunity that we speak out our concerns and ask for CIC to increase the limit for parents and grandparents visa. For Parent Sponsorship, the process is little slow and now days at ND VISA Section they are asking for medicals and passport at same time.

Hello fellows, The following is the detail of ecas status of my parent sponsorship application----

"We received your application to sponsor XXXXX LLLLL on May 7, 2008.   Please note that dependents listed on your application will only be added to your case once processing has begun."

I was wondering why they say dependent will b added after the processing started. I think according to CIC dependent policy, the dependent is added as soon as CIC Mississauga received the application. Is anyone have the same status as mine? or I'm the only one in this boat.

I request everyone to vote NO at the CBC website link provided above. The poll question is, "Should Canada limit the number of parents and grandparents that it allows to immigrate?" Just vote NO if you want to sponser your parents and have them immigrate to Canada!

Minister Jason Kenney wants to stop the Parents and Grandparents stream of the Family Class Immigration program, or put limits (caps) on the number of applications CIC accepts. Just like the limits of the Federal Skilled Worker program. So just vote NO and rate the comments by clicking on the "Thumbs Up" or "Thumbs Down" button. Some of the comments posted are full of hate, anger and mis-information against immigrant parents and grandparents. You can also leave your own comments to clarify the matter and show them your point of view.

I think if we all look in to latest buzz of Parent Immigration quota being cut. Lot of us will never get to see their parents living with them. Atleast now the government has thought about the agony ppl go through. I think they should just stop the program atleast lot of ppl will be relieved....

The policy just announced by Kenney includes, for anyone who has not already applied, a freeze on parent and grandparent applications. That is, NO more applications will be accepted for this type of sponsorship. Looks like this freeze will be in effect until at least the later part of 2013.

I assume the CIC website will be updated soon. I certainly hope so. It is, though, profoundly disconcerting how callous CIC operates in these matters. To put a FREEZE into place without giving effective notice to those concerned, even after the FREEZE has been put into place, is simply wrong.

Personally I think the law should compel them to accept any applications submitted within a reasonable amount of time (at least two or three days) following the posting of appropriate notice on the relevant web site pages, that is, the pages a person would go to in order to find information about sponsoring their parent.

Governments never announce as change such as this in advance. If CIC had announced that the freeze, pause whatever they call it in advance, they would have been inundated with applications. Add another 3/4 thousand applications to the pile, think of what that would do to any processing plan. Look at all the other changes, they don't announce the occupations in the skilled worker cap before they are posted do they? The only thing that is announced in advance is regulatory changes.

I have an application to sponsor my parents filed in 2008. I have been living in Canada continously since then, but I am now being offered an expatriate position with a reputable international company in the middle east.
 
What would be the impact of me accepting this job and relocating temporarly out of Canada on my parents applications?

To qualify to sponsor your parents, you must be living in Canada. If CIC determines you are no longer living in Canada, your parents' application could be refused.

You're supposed to maintain continuous residency from the time the application is submitted to the time the application is approved. Taking this job will create the risk that your parents' application may be rejected.

The sponsorship application has 2 stages - first in Mississauga and second at the home country. Are we expected to maintain continous residency till both the stages are completed or only till the 1st stage in Mississauga?

What do you think of the issue of maintaining continous residency in Canada during the two phases of the application?
Is there any document in cic or experience whether this residency has to be continous throughout the whole process or is it enough if the sponsor was living in Canada when submit the application and is living in Canada during final stages of the application process?

Regarding sponsor eligibility following CPC-M stage:

My understanding is that it is very simple (no rocket science necessary) --

-- To be eligible to sponsor you must be residing in Canada (among other eligibility requirements).

-- The sponsor must be initially eligible and must remain eligible throughout the process.

The CPC-M stage only assesses the initial eligibility of the sponsor, but again the sponsor must remain eligible throughout the process.

I am not much familiar with the particulars of family class sponsorship beyond partner and dependent sponsorships, so I do not know to what extent there are mechanisms or processes that effectively enforce the required eligibility requirements for sponsors past the initial approval phase in CPC-M, although I'd expect there to be some, including, not the least, the continuing requirement to notify CIC of material changes in circumstances.

This really is obvious. Just the underlying policy itself, unification of family (despite the current hyprocritical state of CIC practice as opposed to its increasingly Orwellian proclamations of policy), answers this question. It is not a vehicle for immigration generally. It is a vehicle for bringing families together in-Canada.

@ Tarik, to my understanding if u can maintain ur PR status or citizenship valid u r suppose to file taxes & if u can show required income it shouldn't be any problem, just a thought

I will check with a lawyer just to see how should I approach this in a way that I still accept the oversees job and still not jeopardize my parents sponsorship.
 
In CIC website, one of the conditions that the sponsor has to meet is "to live in Canada". I was living in Canada when I initially applied for sponsorship, and I will be living in Canada when final approval comes (four or five years from now). I will only live temporarly out of Canada for three years due to my work commitment.
 
I think that the sponsor need to establish Canada as a home which I do. Travelling for few years due to work commitment shouldn't be an issue especially that I will be already back by the time CIC makes their final decision.

Just be careful about the "lawyer" you consult with. Avoid consultants regarding something like this. (Many consultants are, probably, fine, a good deal perhaps, but so many are outright bad it is not worth the risk; and there are indeed many consultants who appear to actually facilitate getting around the law or regulations, and these are especially a bad, bad idea.) Definitely be certain the lawyer is one whose primary area of practice is immigration law.

Also be aware of the continuing financial requirements that the sponsor must meet . . . and especially that generally financial resources must originate from Canadian sources. There are exceptions, including one for sponsors living in Canada (and declaring the income in their Canadian tax return) . . . but whether or not just having a home address in Canada and filing a tax return declaring the income will suffice I do not know. I doubt it (see circumstances in which a sponsor may be deemed ineligible in http://www.cic.gc.ca/english/resources/manuals/ip/ip02-eng.pdf - the IP 2 operational manual section 13.2).

The ongoing financial capability requirement is significant, I am afraid, since it suggests one of the ways the issue could arise given, it is my understanding, that income may be reassessed at any time. (Near end of this post I discuss the sliding-by idea, which I do not condone let alone recommend but of course it is something that I am sure many elect to try.)

If you have not yet perused the http://www.cic.gc.ca/english/resources/manuals/ip/ip02-eng.pdf - IP 2 operational manual , you may find the information in section 13 (beginning on page 38) interesting if not useful, where it explicitly discusses sponsor's residency in the context of sponsor eligibility. Note that 13.3 in particular addresses "sponsorship by Canadian citizens living abroad," which says things like "Canadian citizens ho are long-term workers . . . in another country are generally considered residents of that country."

My understanding of the eligibility of Canadian citizens living abroad is that it is strictly limited to the sponsorship of partners and dependent children.

Section 13.2 lists some circumstances, related to place of residence, in which a sponsor may be found ineligible (including having a house in Canada but working abroad).


I suspect that what aad809 is alluding to is essentially something along the lines of a getting-away-it approach, as in that should be easy, and which to some extent you may be alluding to in saying that at the critical phases of the process you will indeed be living in Canada. I also alluded to this in my previous post (referring to my lack of familiarity with how sponsor eligibility is enforced post-approval) though I must say that stuff happens and even if it is easy to slide by it would still entail substantial risks. And be aware, this government seems to be more engaged in looking for and identifying discrepancies and issues than Canadian immigration was for many years.

For whatever it's worth, I've seen several stories on forums like this one over the past couple of years where people were rejected during stage 2 for leaving Canada and taking a job elsewhere. In these cases they lived in Canada until stage 1 approval was received and planned on moving back to Canada when their parents' application was approved. But they never got the chance. Part way through stage 2, they were suddenly asked to provide proof they were still living in Canada full time and couldn't (filing taxes is certainly not enough because you can do that from anywhere - same goes for owning property). CIC was looking for hard proof they were PHYSICALLY spending the majority of their time in the country. They couldn't supply the proof requested and the applications were denied. I'll see if I can find any of these threads so that you can compare them to your situation.

So regardless of what your lawyer says, I think you're creating the risk of a refusal based on non-residency if you take a job outside of Canada. Whether CIC finds out or not is a different matter (I have absolutely no idea how often CIC checks for these sorts of things). And I agree with dpenabill - be careful who you consult with. You have a lot more to lose than they do.

Good luck regardless of what you decide to do.

IMHO I think we are going to see the end of parent/grandparents sponsorship as we know it now. I think that it will become closer to Australia's where you have post funds to cover their future medical care.

I agree with PMM that we are probably seeing the end of parent and grandparent PR sponsorships as it has been to now.

In fact, as I have said elsewhere, Kenney has telegraphed this emphatically, saying, for example, that the current system is "unsustainable," and thus, to me, calling the current freeze a "pause" is a bold faced lie. There is no intent to resume, so this is not a pause, not by any stretch of language. I try hard to encourage people dealing with immigration to be forthright and honest in their dealings with CIC and CBSA and the Canadian government generally, and I do indeed think this is the best approach to take for practical reasons, but it is a hard sell when the Minister himself, fully intending the current system of parent sponsorship to be terminated, repeatedly calls the refusal to accept applications a "pause."

In any event, for those who have their applications in, this is probably as good as it is going to get, especially if CIC does indeed approximately double the number of PR visas of this sort being issued annually for the next while.

You are expected to maintain residency for both stage 1 and stage 2 (i.e. the entire process).
 
Thanks Scylla and Dpenabill. The logic of "family reunification" is pretty clear and as you have mentioned it is not a vehicle for immigration - rather a mechanism to bring families together.

Step 1 (Process in Canada) gets updated every week and the second step is quarterly. It's disappointing to find out that the wait time in Canada is getting longer; from 49 months last week to 50 this week. I think they are super busy preparing for the super visa applicants.

my father has 5 years tourist visa & he is living here in canada. we  are waiting for New Delhi approval. at the time of approval is he has to be in india to do medical & other formalities or we can  finalize his immigration from canada only?

Hey I think he can stay here continuously for 6 months and extend his visa i guess...and do his medical here. He has to go back to re enter canada with immigration. He is probably gonna be sending police clearance again if expired so i guess he has to be there for that.

guys good news, my father has received medical papers & has been asked to submit passport within 60 days. I have a question:

I have notice that sometimes it took over 6 months to get the passport back with the immigration visa & he cant come to Canada on tourist visa without a passport, so is there any way that he can do his medical here & submit the passport from Canada only. (my father lives with us since 2008 on/off since nobody in India to look after him.)

1. Yes he can do his medical at any DMP in the world.
2. The problem will be that it is illegal to mail courier passports in/out of India and CHC Delhi will only send the passport to an address in India. So you will either have to find someone to carry the passport to India and return it to Canada when the visa is issued.
