Hello Members,

I am Canadian PR ( including my family) and landed in Toronto in April 2008. I stayed for 1 week and returned back to Saudi Arabia where I am presently working. Now I am planning to return to Canada for good sometime in August 2010. I have with me both PR and SIN cards. The expiry on my PR card is April 2013. I would really appreciate members replies on my following queries:

1)Would I have any problem reentering Canada after approx 874 days of absence?
2)I have not filed any tax return as it was not applicable during my absence from Canada. Any issue on this?
3)I did not apply for health insurance or any other benefits when I was in Canada for 1 week. Any issue on this?
4)Do I need Returning Resident Permit to re-enter Canada?
5)I had declared my personal belongings in the customs to be shipped at a later stage at my first entry. Now if I send/ship my house hold personal belongings for the first time to Canada, will I have to pay any duty on my items.
6)If I bring fund in form of Bank Draft, is it taxable at a time of deposit to a local bank in Ontario?

Mostly ditto.

If I was answering first, I probably would have said, however, "probably no problem" since, well, there are are rarely guarantees and life is rarely definitive. But if limited to the specific issues you raise, yeah, blackpearl was right to say "no problem."

For example, basically you have until end of March 2011 (actually up to a date in April a few days after the date you landed in 2008) to return with there being NO issue about meeting the residency requirement (since 730 days are left before the fifth year anniversary). For another example, any goods you declared as "goods to follow" previously you should be able to import duty free . . . but of course that would not include items purchased since the previous date. And so on.

Don't worry and no problems. Count two years from the expiry date of your PR and enter before that date. This is to meet the minimum residency required for renewal of PR.
As far as your PR Card is not expired you can enter Canada. Read my earlier post for more details.

hi guys i have few questions to ask:

i will be having my interview on 26 of May and im going back to Philippines in the same day right after my interview...is that gonna be possible to happen?
the paper that the immigration will be giving is not valid to show in coming back to canada...
is there anybody who have tried my situation???

This interview is for what, may I ask?

Are you a PR, or a foreign worker?

Why are you leaving right after the interview that you have mentioned?

Also, what paper from immigration are you referring to?

HI Beaver.
This interview is for my permanent residency in canada...
I actually scheduled my flight last February 2010 and then my schedule for my interview received this April....this vacation was plan ahead of time withour even knowing my interview my be schedule as early as i got my flight...
the paper from immigration that they give right after the interview but it is not valid to re-enter canada...
somebody told me it is ok as long as i get travel documents in Philippines but i dont have really any idea abt those stuff...

It is better you obtain your PR Card before leaving Canada.

As long as you become a PR before leaving, you would need to obtain a PR Travel Document from nearest Canadian mission to your vacation-place.....

Check the website of the Canadian embassy in Manila for information on how to apply for Travel Document.
(I'm sure you can find the website, if not, google it)

Yes I agree with Canvis that you should probably wait out a little bit, you have come this far. Anyway it's really up to you and how strong the desire is to see your family and friends again. I myself would be raring to go. Masarap magbakasyon sa Pinas. Wink (Translation: It is so good to have a vacation in the Philippines). 

As for obtaining travel documents as a vacationing foreign worker (I assume you are), I admit I don't know the procedures. Google as much information about the requirements when travelling abroad while on a work visa. I heard that you must get a new clearance from OWWA or POEA (I don't know which of the two or both) to be able to pass through Philippine immigration at the airport when you fly back.

This is what I found about leaving and re-entering Canada with a valid work permit:

May I leave, then re-enter Canada?

In order to return to Canada, you must be in possession of a valid passport or travel document. You also need to hold a valid work permit if you are returning to work in Canada.

If you are a citizen of a country that requires a temporary resident visa to travel to Canada, you will also need to be in possession of a valid entry visa to return, unless:

• you are returning to Canada following a visit only to the United States or St.-Pierre and Miquelon; and

• you return before the expiry of the period initially authorized for your entry or any extension to it, either as a visitor, student or worker.

Possession of these documents does not guarantee re-entry. All persons must establish that they meet all of the requirements of the Immigration and Refugee Protection Act and Regulations before being authorized to enter or re-enter Canada.

Well the day of interview s/he lands and becomes a PR.
By leaving Canada as a PR, the Travel Document will be required, unless somebody either sends/mails the card to them in their country or they wait for PR Card, thus delaying the vacation until the PR Card arrives.

Personally though, I feel safer returning with a PR Card rather than the TD. If you return on a TD, at the airport you may be examined by Immigration Canada (secondary) inspection.
Don't panic, it's just formal procedure because of the TD. Just gonna be delayed a few more minutes exiting to baggage hall :p

How long does it takes to receive the PR card upon initiate landing? I was thinking of notifying CIC canada on my actual date of arrival and hope that they can expediate the issue of my card.

Beaver and Canvis,

Thank you so much for the advice guys, but i really really need to go back home...i should be there before June 1st important occasion is happening that i cant miss it...
i hope getting travel document will not give me any problem when im back in the Philippines...i get a little scared when i read canvis post that they will have to examine me again at the airport because of the TD...
hope it will go well...
im not even staying there for more than a month so i really need to get TD cause im only staying there 3weeks and 6days...

don't worry about returning. Examination is just formality it won't cause you any hassle. My post was just to inform you, so don't panic it is nothing serious. As long as you explain to them why you left without PR card, you will be just fine.

Just make sure you apply for travel document in manila as soon as you get there, so that you can get it in time for returning back....depending on how long the embassy takes. Make sure to go and apply in person. You'll get it faster that way.

I did my first landing with my family in Jun'08 and now this year in Aug we are again visiting to Canada and our first landing was in Toronto. We all have PR & SIN cards.
From this year onwards my family plans to continuing staying in Canada where as I would be returning to the place of my work.
I would like to know if we will be covered by local Medical facilities or do I need to take any travel insurance, just in case needed?

It depends on which province you will reside.
A few provinces require a 3 months waiting period before you can be eligible for health coverage, e.g BC, ON, QC

Provinces like AB or SK does not require 3 months period, so you can apply for health card as soon as you move.

Provinicial Health Cards do not extend their coverage outside of their provinces, especially abroad. If you don't have any health coverage in the country where you work, get some type of travel insurance. 
 
When I went on vacation for three months in my home country, I bought three months worth of travel insurance because of the same reason.
 
I don't know if travel insurance covers any other reason in addition to vacations though...

hi...can i return to canada if i can accumulate 630 days of physical presence in canada cuz my pr card expires on 27 nov 2011 n i have been phiscally present for five months in canada
my name is Rabia Intsar and im mailing u from paksitan ...i nedeed information about my status of PR card ....ive got a PR card which is valid uptill 2011...but i visited canada twice ..once three years back for a period of 2 months n now once previous year in the month of novemner... i came back from canada after staying there for 2 months ...now thye say that my date of xpiry when i could re enter canada xpired on 15th of march... one of my cuz told me who lives in canada ....but the PR card is valid uptil 2011.....i dont know about the new rules but he says now u cannot enter canada either u shuld have completed a three months period there before november 15th.....i was terribly sick due to medical reasons i had to come back and could not re enter for the same reasons ...is there any possibilty that on medical grounds they accept my mediacal certificates and allow me to re enter canada afetr the due dates have passed will they accept this case and my application please help your guidance needed

Hi Rabia,

Well your PR Card is still valid, take all the proof of your medical, etc and return to Canada as soon as possible.

Immigration will ask you (at airport) for the long stay outside Canada, be honest and tell them everything honestly and why you were unable to come back earlier. I'm sure they are very considerate and will understand your situation and will try to help you.
Once you return here, you must stay for at least 2 years and then you can apply for PR Card renewal.

So what you need to do is to return to Canada as soon as possible.
