HI Colin,

I applied for PR under Skilled program last Week.
As per USPS, they recieved my documents on 20th Sep, 2013.

I am still not having any response from them. Also even my credit card is not charged which can ensure me that they have taken my file.

Is there something to worry

i think that immigration process is very easy and clear steps and you can do it alone with following all the required documents in the CIC page..

dont make my mistake to use a lawyer...no need believe me,,,safe you money.

The cap is full, so it is pointless to apply, your application would be returned.

Hi Attorney,

I applied for CSQ as single on Sep 2008 and i received the CSQ on Juin 2012. However I got married on Oct 2012 I send required file to BIQ to get spouse CSQ (marriage Cert, Original CSQ, Spouse diploma...). BIQ send me receipt on Feb 2013 and told me that my request is under process and I should wait their decision.
till now (11 month waiting) i didn't get any decision. I was waiting CSQ of my spouse in order to send them together to start Federal process but till this moment i didn't get any reply from BIQ. I am in situation that My CSQ will expire after 1.5 year and may loose my CSQ if i wait longer.

I have 2 questions:

1. I need to start PR Federal at the moment and sponsorship my wife later. How i can explain this to CIC ? there is a question in application IMM0008 "will dependant accompany principal applicant to Canada (Yes/No)" if i reply by "No", did they accept my application ? Can i sponsorship my spouse later?

2. If BIQ send me CSQ-Spouse after starting Federal. Did CIC accept updating my application and tell them "Yes" dependant will accompany me to Canada ?

1: Assets
2: Liabilities
3: Settlement funds

Hi There
I applied for immigration under Manitoba PNP program in January 2013. Received my File Number on 29 January 2013. At the time of application filing my IELTS score was valid. 
IELTS expired on 22nd October 2013, however my case is still under process at Manitoba Immigration.
QUESTION: Do I need to re-take IELTS to keep my score valid until case is finalized?
A quick response will be highly appreciated.

My boyfriend and me want to get married, but he was deported from Canada twice
He is back In Canada, but we dont know what is the options we have to get married and he can get his permanent resident status.
I would really appreciate some advice and even if somebody can recommend me a good inmigration lawyer

I moved a similar post to the Family Class Sponsorship forum here, under a new topic titled "Deported boyfriend . . . if we marry . . ," and I offered a bit of a response.

Mostly see the CIC web pages for family class sponsorship, which have most of the information you need to know.

A lawyer is a good idea, even assuming he is in Canada legally now. If not in Canada legally, seeing a lawyer sooner rather than later is important.

Sorry, I do not have any recommendations for a particular lawyer. Note, though, this site is maintained by a law firm engaged in immigration law.

Thank you in advance for looking into my question.

February, 2013 I received a confirmation via e-mail that the processing of my PR demand was completed. I was asked to send passports & pay PRR fee. All was done. CIC confirmed that they have both passports since July, 2013.
After a month of receiving no passports back, sent them an e-mail requesting the delay. Had no reply. Asked interaction of a deputy. After a week all of a sudden instead of receiving passports I received a request to fill out new form Background Declaration for the reason that one period was not covered. I did. That period indicated "Unemployed". Sent back in September, 2013. Since then - nothing.
February, 2014 - sent another request to Case Management asking for an update. Received an answer that Background Checks (in plural) are ongoing. And that after 5 months!

Question 1. Under what pretext I would be asked to re-fill a form if I previously received an approval & was asked to send passports for visas?

Question 2.  If they needed an update (in case of missing period) & that information had "no information" to work with how can it take so long?

Question 3. My Background Checks were done back in 2011 including criminal with fingerprints (that was confirmed by CIC). What could they be doing now: a completely NEW check or an UPDATE based on the information of 2011? What's important I never left Canada since, so it means I couldn't do anything in my country nor here or else it would pop up in the system as a "red flag" or so? No?

P.S. Never had & do not  have actually any issues with criminal law nor medical.

I appreciate your answer & possible clarifications.

As long as you apply for the work permit before the LMO expires, you are fine.

Hi dear friends,
I have two quick questions for you guys and would very much appreciate it if anyone can share their experience or knowledge:

- Was wondering if one applies for CSQ under the PEQ from inside Quebec and while awaiting its issuance or just after that, leaves Canada for a short-term training (2 years) in the US, does that cancel the CSQ application or the subsequent federal PR application?
- If no, can he/she submit the subsequent federal PR application from abroad after obtaining the CSQ?

- Alternatively, can one apply under PEQ from abroad?

Hi mariam ,go to immigration site www.cic.gc.ca and check ur occupation list for skilled workers fow central intac if there is available list of ur profession then apply directly to canadian immigration office check where u have to submit ur paper according to country may be in uk office for pakistan,and one thing more recently nova scotia lounch provincial nominee programme just check it ur profession if available then u r eligible.and apply .

I am soon to be retired (early) from the United States military. All of my education has been through them with the exception of a BA in aeronautics which does not equate to any of the CPRP skilled worker programs. The industrial technician and mechanic field is the closest program that may work but it's still a long shot. The provincial programs are much the same for Saskatchewan. What's my next move? I lived in Canada for 20 years prior to the military and would really like to come back.

Hi Colin,

My boyfriend currently has the Young Professional Visa allowing him to work in Canada. His visa runs out  Sept 2014 and he would like to apply for PR. His work wants him to stay on but will not provide the paperwork to sponsor him for the PNP, so we're now looking at other options:

1. Canadian Experience (I don't think he is eligible because he does not have a management or labour worker position)

2. I sponsor him but this is our last option

3. Visa extension. Is it possible for him to apply for an extension to his current visa if his work will provide him with a letter verifying his employment and their need for him to stay on?

Any advice on this would be helpful and appreciated.

Hi Colin!
My problem is , my work experience is not from a last ten years I had been working as welder from 1999 to 2003. I completed  a 3 years  Skilled Worker training school,I hold a Skilled Worker  Certificate from Car Body Mechanic and Welder. I have heard there are some occupation , for example welder, is not necessary to have a work experience within 10 years.Can I get any kind of immigration or work visa to Canada with this skill background?

Hi Colin,

I am confused about my NOC code, here is my situation -

I sent an email to HRDC(several times but got same got) to get a suitable NOC code for my job and they gave me NOC 2172 Database analysts and data administrators. But I took an advise from one lawyer (the lawyer is approved and experienced as well) and he said my job does not fall under any NOC code, Moreover my wage is $2 less than the required wage rate in this category which is $18.50. Please help me with this dilemma. Following are my job duties I sent to HRDC -

My job mainly consist of collecting data from web, analysing and refining collected data for customers. I also upload items and modify my company's ERP system. Details about my key job responsibilities and company are as follows:-
 
My company has been operating since 1947 and it is Canada's leading distributor of bearings, power transmission, motion control, belting and conveyor components etc. I work in a Data Management Department as a member of a Product Information Management (PIM) team under the job title of Product Data Technician. My key job duties are as follow -
  • Assist in gathering product data from existing engineering drawings, paper records. Collecting products data from the web by manual search and software applications.
  • Analysing the product data that involves:-
    • Identifying, parsing & organizing the product information elements such as products technical specifications and description. 
    • Identifying, fixing & enriching the missing and low quality data product data.
    • Correcting inconsistency in the products data.
    • Monitoring and reporting other data quality issues
  • Manual data entry into relational database from existing paper and electronic records. 
  • Assist PIM Manager and Subject Matter Experts (SME’s) in organizing the products data.
  • Data management support among team members as needed.
  • Uploading new items, modifying records and updating costs in (SX) ERP system used by the company.
I have also done a B.Tech in Computer Engineering from India and completed 2 Years Business Operations Diploma in Canada.

I would like to apply for canadian immigration. Actually I was thinking of appointing an immigration consultant for the same, but after reading your post, I felt like, is it really that easy?

One most important thing is I am confused as to which list of eligible occupations would be applicable from May, 2014 onwards, since following two links have been provided regarding the occupations on the CIC website:-

http://www.cic.gc.ca/english/immigrate/skilled/apply-who-instructions.asp?expand=jobs#jobs (Only 24 occupations have been provided on this link unlike on the above link)

Do you have any idea which occupations list among the above two would be applicable from May, 2014 onwards or would there be a complete new list of occupations to be introduced in May, 2014.

Also 'Cap of 300 reached’ has been mentioned for some professions on the following links,

I applied for immigration, after that I got last online updated of my application in December,2012.which are given below

"{We started processing your application on February 29, 2008.
We transferred your application to the London England office on January 27, 2011. The London England office may contact you.

A decision has been made on your application. The office will contact you concerning this decision.}"

After that I did not get any update about my case. Please you help me How can I know about my application status.

Today they have 4 years living at Canada and i like to know if she can ask me and for how long i will have to wait to travel to that beatiful country. She have canadian citizenship already. And my wife and i have two kids. age 7 and 1 and we are profesional in business administration.

Is it easier to apply to the PR via Skilled worker or it is going to be faster and cheaper to to do if my sister apply to sponsor her family member.

1. Your sister can't sponsor you. Although you would get 5 points for her in adaptability if you apply as a skiled worker.
2. You should check the following to see if you are qualified to apply as a skilled worker. http://www.cic.gc.ca/english/immigrate/skilled/apply-how.asp
3. Depending on your country of residence an approved application takes anywhere from 10 to 33 months to process 80% of the applications.

Hi Atty. Colin I have a question regarding My job title. It does not match the job title list in the NOC but my job description is the same with the one under the financial analyst category. Given that banks are strict on their records (i.e. Certificate of employment) there is no way that I can request for a change in job title to financial analyst or to insert the title in my COE. My questions:

1. Would this be grounds for my application to be automatically declined given different job title? Are they strict on this issues?
2. Does the embassy put more weight on the job title or on the job description?
3. Should I risk to pass my application even with this issue?

Can you please enlighten me.

I am from Karachi Pakistan.  A Post Grad holder in Bachelors of Engineering.  My plan was to apply for FSW 2014.  I score a 8.5/6.5/6.5/8.5 in Academic IELTS.  Can I use this result to apply to FSW 2014? 

So far I remember that Academic = 1 additional band to the General Training... How far am i correct in proceeding ...

I need advise to make the next move.

I am applying for immigration under The Federal Skilled Workers Program and there are a few document issues I am worried about. Kindly, if possible, please clarify them up for me. I am from India  and my questions pertain primarily to Indian document requirements.
1)In the generic application form(IMM0008ENU_2D) , it asks for national identity document. is it important to provide one. Can driving License be used as one if it has a slight error in name spelling. Can the form be filled without filling the NID column.

1. You have to show funds in your name for 1 person as no dependents are accompanying you.
2. No, she is not included in the application so she doesn't require a medical exam.

I have lived and worked in Canada for 4 years with a working holiday visa (no consistent)
2008-2010 then again from 2012-March 2014 this year.

I'm trying to apply for a PR card but I'm not 100% if I meet the criteria as I have been home working in Australia in between? Lina: about 700 days.

Yazan: 29-12-2000, 715 days.

Laila: 25-08-2002, 715 days.

Bayan: 18-09-2004, 715 days.

Mohammad: 10-10-2007, 715 days.

 

 

I have contacted some people in Canada to about the best way for renewal. I was told that Adults and children above 12 years must be present. Based on this, Lina and Yazan are currently in Canada with the other three kids in Jordan.

Lina told me yesterday that all kids must be present based on another advice.

 

I appreciate your kind feedback ASAP.

 

For me I stayed in Canada for three about six  months only. Not sure how my situation will be.

I hope you are doing fine. I am planning to apply for a Canadian PR under FSWP pretty soon and basically getting my documents ready these days including IELTS, ECE etc. Everything else seems fine and I easily score the required points, however I have a question regarding my marital status on which I need your advise. I got married in 2011 but I am planning to get a divorce in near future. I am physically separated from my wife for the last 6 months and effectively no contact with her so I don't have any of her info/documents etc to attach to the application and the fact is even the spouse not accompanying, I still have to provide of lot of her documents which I have dont any access

My question : Is it okay if don't show her as my spouse in the application and show myself as single since I will get divorce anyway in near future. Someone even suggested not to hide my marital status and attach a letter with the application explaining my situation in detail. Please advise which is the best way to go about this issue. 

Your prompt response will be highly appreciated in this regard.

Me and my spouse applied for PR status together (me as her dependent) through Immigration Quebec's Quebec Experience stream, a fast-track that allowed us to apply shortly after both graduating from a Quebec university. We were selected and we applied for PR, and now we have our Confirmation of Permanent Residency. We were never asked for Proof of Funds at any point during the process, but I assume we'll have to show it upon landing (we'll be doing so either at a point of entry or a CIC office in Ottawa - we live in Gatineau right now, with PGWPs). I'm a bit confused - do we have to demonstrate the same funds asked for Federal Skilled Workers or the funds listen on the Immigration Quebec website?

CIC has already received my FSW application on 29th august and just today I found out that I made minor mistake in travel history form IIM 5562.

I misspelled my name "Ishwarkumar" as "Ishwarkuamr". 

I am worried now. Will CIC return my file on the basis of inconsistency in forms.

I have submitted all my PCCs, medical and passport to delhi office for PR stamping. It has been 9 weeks since they were submitted. My online status is 'in process' and I am still waiting.
I wrote to the provided email 2 weeks ago but never heard back after the automated reply. Any idea how long does it take. I have not come across anyone more than 2 months. I am starting to get worried.
Also, I am in the USA, and have sent in my passports to delhi. Need my passports to travel soon. Any advice? Thanks!!

Hi,

I have worked with 4 organisations till date. And out of the 4, only 1 organisation that I worked for was relevant work experience for which I am claiming points under the FSW.

Now in the form IMM 5612 (Document check list), point number 12 (Work experience), it says that I need to get reference letters from all employers. 

So is it necessary to include all the reference letters of all organisations, or only the 1 organisation where I have gained relevant work experience for which I am claiming points?

There is a clause in the FSW documents checklist, stating that "Legal documents showing name or date of birth changes" should be provided.

In my ECA report, It is mentioned that the credentials provided represent a level of education in Canada comparable to :
          . Bachelors Degree ( 4 years)
          . Master of Business Administration

I am not sure either i will get 23 points or 22 points. Because my master degree is not relevant to applying field.

We are trying to apply for birth certificate. But are told that there is no gurantee we will get it. If there is no entry in the municipal register we may not get it.

Can I use my brother's adhar card, a new personal identity card that states his father's name?

Then you have a problem. ND will NOT accept affidavits, as they are considered self serving, nor will they accept passports or BC issued by the Indian consulate either.

              i prakash from india wanted to apply for canada, i fall into  NOC code 2171, is it ok to 
              to apply now, as of today 311 applications have been reached Cry.
              or should i apply next year and canada immigraion website states the current immigration                       system is last for this year, and from next year it would be express entry system Confused?
              My doubt is what is express entry system ?and how would it be?

PLEASE HELP

I was detained for one night and got ticket for alleged DUI (1%). My car and license were taken away too.

They released me next day after invalidating the breathalyzer test, no charges were pressed. I still had to pay the traffic ticket (less than $70) they gave for the alleged DUI to get my car and license back as fast as possible because I use it for work(if I had appealed the infraction it would have taken too long to get it back).

My police certificates/clearances look clean, no criminal records or detentions.

Should I mention this situation in any way in the Background Declaration form?
How should I respond to question J:
been detained, incarcerated or put in jail?
Will this affect me in any way now that I'm applying for PR under FSWP?
When CIC do the background check, do they check the applicant's transit/driving history or internal police records/logs?

Please I would greatly appreciate your advice

Hi Colin

I was told to submit all family passports within 30 days for PR, I have British and my UK born son has Indian passport expiring in July 2015. Can you please guide on followings:

1. Can Canada Embassy extend the passport submission time period as I was thinking to get British passport for son through MN1 registration and it may take up to 2-3 months to finish the whole process.

2. If I submit his Indian Passport and latter on decide to apply for British so is it possible to switch over the PR to new passport.

3. The final target is to get British passport can see what best to do for this as I am not in hurry to move to Canada now. Please suggest in this regard. Why I haven't done that before as I was thinking to get his British passport after the expiry of current one.

Jassee, I am not a consultant btw, nor am i trying to sabotage Colin's forum,  jus a regular applicant like urself. Ok moving on to the question. They usually like the passport to have at least 6 months before expiring to place the COPR (confirmation of PR) in there. Also the COPR acts like a one entry visa, so the COPR is no longer valid after you 'land'.
All of this would suggest that you can have the old passport stamped, esp if you intend to 'land' before your passport expire, then when you are in Canada you can proceed to getting the new passport.

OR as you say, you could email your local VO asking for an extension citing the situation, and they may give you an extension. Just giving you some options.

I really appreciate your time to reply,
Just wondering to find out if I can still register my 5yrs old son as British citizen through MN1 during my stay in Canada and furthermore can applied for his British passport from there. I am very much sure about the renewal of his Indian passport from Canada  but the intention is to get the British passport.
 
Local VO office may reply too late until that to initiate the registration process will be delayed for another month.

Not so sure how the application process would work in Canada. But you do have the option of leaving Canada temporarily after, to sort it out. This document is to allow you to get back into Canada after you leave if you do not have a PR card.

You probably do not have to go in detail about what it is you need to do at immigration. You can probably tell them you have some personal matters you need to clear up when you get to immigration when you are landing and get this document over there.
So you are able to leave and sort out your business and come back in a few weeks or months. I would not advise taking too long, but if its 2-3 months you need, you should be covered. 
I also during my checks a while back that Canada is not against having multiple citizenships. Dont remember where i read it, but u can google it.

You can actually download the form and have it prepared for when you land, or you could wait another 2 months when your PR might possibly be ready, so you would not need this document, but as you say, you working with a timeline.

  I have recently filled out the online assessment form for immigration on the CPRP program. I am a successful applicant from which I have received a notification from your office. I would be with my wife and 3 dependent children .
  I have had a look around the website, but cannot find answers to clarify my questions.

Firstly,  I understand I would not be guaranteed to find work in Canada. But if and when I do, I am assuming after receiving (from you) a skilled worker visa for myself and an open visa for my wife, that we would then travel to Canada and find somewhere to stay. Put the children in schools and then carry on with the employment I have gained. On the application form, it asked for our "Net worth". Without selling our home in France which we own without debt, we have only 7 to 8 thousand Canadian dollars. So without gaining permanent residency in Canada,  our "Net worth" is tied in France as we would not want to sell our home without the security of residency in Canada. Is this the usual position ?, or are we expected to sell our home and move the funds into a Canadian Bank account ?. Obviously when I know the answer to this, might have the option to rent our home out to another family in France for extra income towards our life in Canada.
 Secondly, under the CPRP program, is there a minimum of two years working in the country to secure residency ? unless the laws are relaxed.
 And lastly,  I understand you would be looking after the program for us for 2 years. If I have found work , gained the visa's and we are in Canada, but the two years have passed before we have managed to gain residency, I guess we will have to employ your services again for the latter part ?
