Subject: Work permit extension. Live-in caregivers
Date Posted: 23 Dec 2009 at 4:30pm
Hi everyone. First of all I would like to thank everyone who takes time to reply to post and help each other out.

I've filed my work permit extension with the same employer as a live-in caregiver (Vegreville received it November 12) and I was wondering if anyone has some recent experience. They say it will take around 75 days. Is anyone in similar situation? any news or updates? I'm just worried cause my current WP expires Dec 31 this year.

I've got to start getting ready to apply for PR in March 2010 but I'm a bit worried that I won't get my new WP in time. Does anyone know if their workload is affected by the Olympics at all?

Thanks for reading.

Merry Xmas and Happy NY to all!

You are on implied status until you hear from CPC-Vegreville. So you can continue working with your old employer under the conditions of your old work permit/contract. Did your employer apply for a new LMO?

Thanks job_seeker.

I was told by the agency that my employer didn't have to apply for new LMO cause my initial LMO is valid till Dec 21 2010 ( so it's like one more year). I couldn't get my WP till that date, when I entered Canada, as my passort wasn't valid long enough. I got a new passport and applied to extend my WP for 1 more year. I've attached the LMO copy with my application. Hope I did the right thing.

Hi,

Was just wondering if you were able to get an extension for your work permit.

Hi,
I haven't heard anything yet. I spoke to a call agent and I was told that I had to wait to hear from them. It takes around 79 days (according to CIC site, if received till october 12, 2009). Mine was received November 12th (according to Canada Post), so I figured I should hear from them some time in February, beginning of March, if I count business days.

Though it is confusing. In the guide section <What happens next> it says: "You will receive a letter regarding your case and you will be informed if you need to take any further action. ...If your application for a work permit has been approved, an immigration document will be sent to you." I thought I would receive some kind of confirmation letter, that my application is received and they are considering it.

Anyway... just have to wait and see. I'm a bit worried though.

Thanks job_seeker.

Wish me luck!

Madeira, howcome you applied for a new work permit with the same employer? How long did you have the previous work permit for?

I don't think you have anything to worry about. If you're under the live-in-caregiver program, and you followed the rules properly, all should be a matter of time, and stamps.

Also, when you applied for a new work permit, did you do it three months (or so) before your current one expired?

Oh, Madeira, if you're interested, please come join our thread in the Sponsorship section, where Deewai and myself are sharing our experiences while we're waiting for permanent residence. I think it would be good for you for future reference as well. You'll find us under the "WAITING FOR OWP AND PERMANENT RESIDENCE FOR SINGLE LIVE-IN-CAREGIVERS" -- (SPONSORSHIP THREAD).

Hi Carmenuta,
thanks for your post. I do read your thread on OWP and PR and was going to join when it's time for me to apply.

I had my LMO till Dec 31 2010 but my passport was valid till Dec 31 2009, so I got my WP till Dec 31 2009. I arrived March 2008. So this March will be 2 years and I can apply for PR. My employer still needs me so I've applied for extention with the same employer, I've applied for one more year. This way I'll be at least covered while I'm wating for OWP.

I couldn't apply for my new WP 3 months in advance cause I only got my new passport in the beginning of November and I applied right away.

So, I hope as you've said it's just a matter of time and stamps. It's been over 2 months since they received my application (according to Canada Post)

I will post any updates.

Hi madeira,

you do not need a new LMO if you are applying WP for the same employer. WP processing for same employer is 76 days and they are processing those received as of Oct 30, 2009.

So, there you have it, Madeira. You should get yours soon, then. I understand now about your WP. You would still be covered. It's what CIC calls "implied status" (which is being allowed to work for the same employer even if your WP expired). In my opinion, it IS better to have a renewed WP, you get to still pay for your medical insurance, and drive if you have a driver's license ( I miss that :-() but hopefully, soon, I'll get my OWP. Let us know how things are going with you, ok?

Hi Carmenuta,
 how is it going?

I've got good news - I received my WP in the mail today.
(application received Nov 12, 2009 ---- WP issued Jan 18 2010)

Now I can relax for a bit and start my PR thing. So I guess I'll join your thread soon. But I have a question already :) Do you have to submit your paystabs (statement of earnings) when applying for PR ? I don't get paystabs. I read somewhere ( I think it was the old forum) that T4s, Option C printout and letter from the employer could be enough. I don't get paystabs. Any info would help.

Thanks

Hm. I know some employers don't give out pay stubs, unfortunately (because it IS their job), but you do get a check every month and you pay your own taxes, I assume, or does your employer pay your taxes? Your T4 slips, and option C print out would be enough, but I would double check with CIC. Also, if you have a reasonable employer, you could ask them for pay stubs, and see what they have to say about that.

The list does say you should include your pay stubs, so... I think it's best that you have them. Let me know, ok?

have a nice day!

What a relief! I was thinking to send those monthly tax papers too.

Have a nice weekend.

Those ARE your pay stubs. You get a paid a pay stub every month, so that's what you sent. They are exactly what my employer gave to me. Madeira, you'd be better off asking CIC about it. They won't give you a hard time but you want to make sure. People's "opinions" are not reliable. So, do the SURE thing and inform yourself straight from the source. We can tell you this and that, our opinion but it's better to have everything covered. Most people's applications are rejected because the people are not informed properly.

Don't worry, all will be fine... you've got tones of time! By the way, where are you from?

Hi Carmenuta,
thanks.

I will call CIC at some point. I did call them while getting ready for WP extension. Other people's experience is important too. It can help you avoid some mistakes.

Well... I've got a month and I can apply for PR in Macrh. It'll probably be the end of March. Getting those Police Cerificates is a pain! I need one from Russia and one from UK.

A lot of people complain about it. You get all those things before you come to Canada and now you've got to do it again.

I am Russian and now I'm in BC. What about you?

You're right... other people's experiences are very important, but not their "opinions". I remember not sending a piece of paper where I was supposed to just mention that I didn't have any dependents (thinking I didn't need to) and CIC called for that paper even if it wasn't necessary. CIC wanted that from me. How much more important are your pay stubs than that blank piece of paper, basically. What i'm saying is you should INFORM yourself before you can rely on what us, people, here will tell you.

I asked where you were from, because you will need a police record from your country and you will have to start that as soon as possible, like now :-), and that police record will also have to be translated along with your other papers which are in Russian. If you need a place for cheap authorized translations, go to MOSAIC, on Commercial in Vancouver. It's maybe 15 minutes away from Commercial Skytrain Station.

I'm from Romania, and live in BC, right now.

Oh, I'm not sure how it all works in your country, in Russia, but what you can do is get your parents, mom or dad, to get the police record for you. You can send your mom the right of attorney (which is what i did). She should send you some identification card so you can get the right of attorney done here, in BC and then you send that to your mom or dad or whomever you want to give your right of attorney to, and it will take you less than a month. It took me about 2 weeks. If you go through the Embassy or Consulate here in Canada, it will take you at least 3 months. It's your call. All this info is available on CIC website as well.

Thanks Carmenuta.

That's exactly what I'm doing right now, getting the paperwork ready for Police Certificates. Just debating about Russian one. When I applied back in the UK, I got my parents to ge me one back home.  CIC tells you to get it from the ebmassy if you are abroad, but you are right, it might take up to 2-3 months. From what I know, lots of people used certificates issued back home and got them translated. It worked just fine.

Have a good weekend.

You have a great weekend yourself, Madeira. Good for you! Yeah, they accepted my police certificate just fine. It was as normal as it could be and it took less time. I remember getting anxious over that one matter 8 months ago. I freaked out because i had no clue they would take so long to give me one, so then I went on a shorter route, more expensive -true- but it got me what I needed :-). You take good care! You've got good supporters here, so don't worry!

hi madeira.... they won't send you anything... if you apply for an extension of your work permit with the same employer..processing will take 60-75 days upon the receipt of your application... and you should send your papers at unit 202

they give priority with those applying a new work permit under new employer which is 30-45 days processing....documents should be mailed to unit 555

both units are with the same address and building... you said you are applying for an extension of your work permit with the same employer...you should sent them at unit 202...but if you mistakenly sent them to unit 555... they will still process it but will take a longer time... just like what happened to me...

God bless...

my girlfriend applied for her live in caregiver visa about a month ago.
she will be in canada for 6 months come May.
can she stay in canada while waiting for her visa even though her visitor visa is only 6 months?
If not is there any way for her to stay in Canada longer than the 6 months?
i read today that she has to go back to the States after the six months and can not come back for another 6 months.  if this is true is it valid if she receives the visa while in the states?

She can apply for a visitor extension once inside Canada, apps to CPC-Vegreville. No guarantees getting approved but worth the try.
