When can my husband return to the US?

My husband has a visitors visa for New York and was recently there from october 24 2009 until February 21 2010. (4 months) He has a 10 year multiple entry visa and has never overstayed his visit. So if he wanted to return in late may, which would be 3 months later would there be a problem at poe? he will only be there for a month.
*NOTE - he is from the Dominican Republic

Is he in Canada now? What is his status in Canada? The question you need to prepare for would probably be "what would he be doing back there again so soon?" He must have a ready response for when CBP officers asked him such questions. Well anyway, posting your query to US immigration forum will probably give you better responses.
