My daughter along with her mother and her younger sister and elder brother is studying in Canada.
They are Canadian citizen. Now she is engaged to a guy in Pakistan whom she wish to sponsor from Canada.It is to be noted that she is not working and studying till another 2 years.Her fiance is working back home and they intend to marry, in July 2012, in Pakistan. After coming back to Canada she plans to apply for him. Expert advice from you people in the forum would be highly appreciated.Thanks. |

Hi dmj, please check www.cic.gov, they will tell you the requirements to sponsor a person for a spouse visa, i have been reading the website to get more information, they said that a principle applicant should have a job to sponsor a spouse to get there to Canada, but they can have co-sponsor ( an employed person that will give financial support to the person from Pakistan) that will justify the Canadian government that they will not ask for financial aid from the government) It is better to inquire with a reputable lawyer near you to get more information.

For spousal sponsorships, you cannot have a co-sponsor (co-sponsors are allowed with some other types of applications - but not spousal). As long as your sister is not bankrupt or on social assistance (welfare), she should qualify to sponsor her husband as a student. Note that since she is a PR (rather than a citizen) she must be living in Canada when she submits the application to sponsor her husband and must continue living in Canada until his application is approved and he is issued a visa.

If she is your daugther the your application will fall into Parents and grandparents Application and at this point CIC is nolonger taking Parents and grandparents Application unless you apply for a Super Visa. If not she was to prove that she is not on any social assistance from the government and show that she will be able to take care of your basic needs for a certain period of time. May be other specialist here will help you out such as pmm.

Hi dmj,
My brother has her file processed the similar way, his wife who was sponsering her was canadian citizen and she was not working and my brother was working in pakistan. Both husband and wife were in pakistan when they apply for citizenship and got it without any problem, being a canadian citizen i provide my letter saying i will financially support if needed and was told it was not needed.

Since your daughter is already a Canadian citizen, she can sponsor her husband even if she is living outside of Canada (i.e. she doesn't have to be in Canada to submit the application). If she is living outside of Canada when she submits the application, she will need to include proof that she plans to return to Canada and make Canada her home again once her husband's PR has been approved.
