HI
who applies for one's Authorized Return to Canada? My friend was deported[was sent a letter to leave and he left; But he was sent letter to the old address and thus instead of leaving as he was ordered in letter[end of 2008] he left in mid of 2009[that's when he got to know he had to leave; he was contacted by canadian border agency, came to the office, they gave him 3 weeks to leave and he left; Does He need Authorized return to Canada??????? he is married to Canadian and is in the process of spousal sponsorship is it him who applies for this or is it imm ?????? does he apply while he is waiting for interview or does he apply after the interview/after being told by imm??? THanks

Hi again...
Here is the quote from the Operations manual... It's hard to tell if your friend was really deported, or just issued a removal order. A letter requesting that you leave Canada is a request, until it gets 'enforced'... meaning that CIC asks him sepcifically to prove that he has left the country (or worse, escorts him to his homeward-bound plane). More information is needed to preoperly answer your question, but from a high level - if he is not banned from re-entering Canada, I'm pretty sure he doesn't need an "ARC". Are there any other members on this forum have more info they can provide?
Who requires an ARC? (Under the authorization of the Minister of Citizenship and Immigration) Under A52(1), a foreign national must obtain a written ARC after the enforcement of any of the following removal orders: • a deportation order (lifetime ban from returning to Canada) [R226];• a departure order that becomes a deportation order (lifetime ban from returning to Canada)[R224(2)]; • an exclusion order:♦ one-year ban [R225(1)];♦ two-year ban [R225(3)].Before an application for an ARC can be considered, the removal order must first be enforced. A removal order can be enforced by two methods: either at a POE, or at a visa office outside Canada pursuant to R240(1) or R240(2). A removal order is enforced under these provisions only after an officer has issued a Certificate of Departure (IMM 0056B). For further information on enforcing a removal order at a visa office outside Canada, see ENF 11, section 13.5. |

Hello
I have a question, who do we contact after we have completed a year ban? also, what does the number mean beside the one year ban, (R225(1)) ? I am a Canadian, married to a Tanzanian. We are currently in Tanzania. Due to a one year ban on my husband, because his student visa expired, he has just completed the one year ban. Where would we go from here? As we both really want to get this organized to return back to Canada! Thank for you're time... |

thanks, may I ask one more question, please what if my friend does need ARC, how does he procced: he is on spousal sponsorship.... he was not yet told by imm that he is getting PR.... DOES HE APPLY FOR ARC right now??? or does he apply after he is told so by IMM????????? Does HE apply himself or does lawyer or IMM applies for him and he just pays??? THanks |

I would wait for it to be requested as he may not even need it.
He would have to apply for it himself and also pay the fee. |

I asked my visa-office how to deal with ARC and the PR.
The Berlinoffice said you can either put the request in with your PR-application or wait for the VO to ask you for the ARC application.
I was asked oa week ago to apply for the ARC after my PR is in process since the beginning of july.
It could differ from VO to VO though.
