Hi - my fiance is living in Canada with me (from Portugal, currently here on work visa) and we plan to apply in October after we are married. Do I send the package to Mississauga or Vegreville?? Or do I send it directly to Paris? Or to Buffalo since he has been here for more than a year on a work visa??
If I send it to Vegreville or Mississauga, do they forward it directly to the appropriate office after that or do I have to do anything? I'm a bit confused, sorry if this has been answered already, wasn't quite sure how to search this! |

Are you applying inland or out?
Outland is Mississauga where they do the first stage approval (sponsor) then they send it to the outland visa office. (After 1st stage approval) Paris is 5-10 average processing times, Buffalo is 4-10. Bear in mind if an interview is required the applicant would have to go to the visa office processing their application. Edited by Saya - 13 Jul 2010 at 12:58pm |

We will apply outland I believe. Does the Mississauga office decide where to send it (Paris?) but can we request Buffalo instead since he's been in Canada more than a year?

It's not as simple as just requesting either office - if he was initially admitted to Canada with status valid for at least one year, he is eligible to have his application processed through Buffalo. It is not based on a cumulative total of time spent in Canada, or time authorized in Canada. Another consideration, if he is eligible to be processed through Buffalo, is whether or not he can get into the States if he has to go there for an interview. If he is from Portugal, then he should be okay as Portugal participates in the US Visa Waiver Program.
In addition, your husband is visa-exempt to Canada, so even if he was being processed through Paris, he shouldn't have an issue getting back into Canada if he was required to attend an interview there, especially if he still holds a valid work permit. Of course, he might not want to have to travel to Paris if an interview is required, and he might not want to have to take his passport to Paris to get his COPR at the end of the process. If that's a consideration, then you might consider the inland process. Because of the fact that he still has a valid work permit, you'd include an extension to that permit WITH the inland PR ap and that would protect his status, enable him to continue working, and should mean that he'd benefit from relatively fast processing inland. It will still be at least 7-8 months until first stage approval though - and then probably at least another 6 months to finalization . . . plus you lose your right to appeal a refusal if you apply inland, AND he shouldn't risk leaving - just in case he's refused re-entry for some reason. If that happened, he'd have to forfeit the inland ap because of the residency requirement. As Saya wrote, Buffalo is finalizing spousal aps in 4-10 months (plus about 45-60 days at CPC-M first before the file is transferred overseas), and Paris is finalizing in 5-10 months. If it went fast, you'd probably have finalization through either office at about the same time he'd just be getting first stage approval on an inland ap - plus there's no residency requirement for an outland ap and you preserve your right of appeal. Thanks for your answers - this brings up a few more questions that we've been wondering about.
He originally entered as a visitor on a 6 month stamp in his passport, we applied to extend that then he got his work visa after being here for about 7 months. He had to leave the country and cross the border again to get the work permit in his passport. Will that count as an "initial admission" or is it the 6 month one that counts? Is he able to travel out of the country while all this is being processed if his work permit is still valid? I was under the impression that once the applications went through, we were stuck in Canada until then. You said it shouldn't be a problem to get back into Canada with a valid work permit. We have a new LMO and are just awaiting a new work permit which should do him from Aug 2010 to Aug 2011. To get an extension of the work permit with the Inland application, don't you still need another LMO to be processed? Or is that not required because of the PR application? Thank you for any information! |
