Work Permit to Study Permit

I came to Canada from England in February 2009 under a 1 year work permit. As soon as I arrived I knew I wanted to stay here and I applied for an extension for the work permit which was refused in January. My employer (an insurance company) applied for a new LMO which was refused. I spoke to a lawyer at this time and she advised me to apply again for a work permit in order to buy me time and so that I could have implied status.

In the meantime I have been working and have also been looking for a new job in the service/hotel industry which I was told is what the government requires for foreign workers. I have had no luck with this so have decided I want to do a 2 year Hotel Management Diploma at Vancouver Community College. This course starts in August this year. Is it possible to change my permit which expired in Feb 2010 and apply for a study permit and still remain living in Canada?

I would do anything to stay here as I want to eventually get citizenship!

I need help so desperately so any advice would be appreciated. Thank you so much.

1. Bad lawyer advice, your work permit was refused. No implied status, if it worked that way you could apply for work permits indefinitely and continue working.
2. You are presently working without authorization, since your permit expired.
3. Without valid status, you can't apply in Canada for a study permit, so you would have to apply outside Canada at either an office or at a Border office when re-entering Canada. You will be require to show funds to cover the international fees, as well $10K for 1 years living expenses and proof of admission to the course.
