w-1 worker visa questions |

Good day all!
My question is about the above mentioned type of multiple entry visa. I have a valid work visa w-1 worker, in my passport. I had a work contract, LMO and all that, medical, everything. Because of personal reasons I couldn't come to Canada. Now the company from whom I had the contract from, because of the economy crisis had to close it's doors. My questions are: 1. Can I enter Canada with my Passport with the "W-1 worker" visa in it? I mean nothing but this. 2. Do I need a work contract, Labour Market Opinion, new medical in order to be allowed to enter? 3. My visa has the following validity: 08/09/2008 08/09/2010. What's unclear is, If I enter Canada let's say next month, will I be able to stay and work there legally only until my visa expires (08/09/2010) or does the validity countdown start from the day you step on Canadian soil? You can enter Canada, but may need a valid contract. You can stay in Canada within the validity of the Work Permit (should you be granted one upon arrival in Canada). You can try and find an employer now and let the employer file for a LMO in your name. Once approved, enter Canada with your new LMO and get the WP under the new employer's name. |

"You can stay in Canada within the validity of the Work Permit" - So I could stay only until 08/09/2010? Isn't it two years after you enter the country? |

No, having a visa does not guarantee you'd be allowed entry. If you have a W1 visa (worker, single entry), you must be able to show proof that there is a job/employer waiting for you in Canada that is why a valid contract is important. If you have an updated contract from the employer who provided you the LMO when you obtained your work visa, then by all means come with confidence. The validity date of your visa will not necessarily be the same as the validity date of your work permit. Your Visa may be valid till Sept 2009 but you may be granted a work permit with validity date until 2012 (depending upon how long your contract is). But having said that, you may be ineligible to enter Canada right now because you do not have an employer, that is why the advice to look for an employer now. The validity of your visa (08/09/2010) means you can enter Canada on or before 08/09/2010. |

First of all, thank you for your help and for clearing these out for me:

" I don't know if there's any difference but it saiz "Multiple entries" on my visa. Does this make any difference? So based on what you say I need to search for a job from outside Canada, get a work contract from the employer and only than will I be able to come to Canada. Can it not be done the other way around? Go to Canada, find a job after I'm there? ...but I guess you already answered this question. In the scenario in which I find a let's say 1-2 year work contract, do I need anything else? Is the passport with the visa + the work contract from the Canadian company enough? Do I need another medical examination / LMO? |

Oh so you have a multiple entry visa. You can try coming to Canada and do precisely what you're thinking of doing- look for an employer while in Canada. I have read posts before from members who did not have employers (employers backed out) but were able to come to Canada while their visa is still valid. I just don't know which Port of Entry. (BTW these were from the old forum).You need LMO. Though there are job types that are LMO exempt. You may also need a new medical if your medicals had been done for over a year. Good Day.I go to Canada last April 13 2010 on a work permit W-1 skilled worker i am dressmaker. my work permit validity is 1 year and my work visa work is 1 year also . i have a multiple visa . i work on my employer for only 3 weeks . i was dismissed by my employer so i have no choice but to go to my home country philippines.now i have my new lmo for noc b also for skilled worker . can i have to apply again for a work visa here in my country philippines?do i need to apply for a work visa and pay a 150;00 canadian dollar for work permit. your faster answer to my question is highly appreciated. thanks you so much for answering to my question.
