Submitting fingerprints while being out of status?

My fiance and I would like to be married soon but there is one problem, he no longer has status in the US as he overstayed his tourist visa. Our plan is to get married in the US and have him remain there until he is asked to return to his country for a possible interview. My concern however is that once he submits finger prints to the FBI they may deport him. If anyone has any information on this, or has been through the process of submitting fingerprints and being out of status please help me! I am so confused
